His attorney, Steven Greenberg, told US District Judge Harry Leinenweber that his client was not present because he was worried his injured foot would be stepped on, according to the Chicago Sun-Times.
Greenberg informed reporters that Kelly was wearing a walking boot and had lost a toenail due to the infection.
The “I Believe I Can Fly” singer has been held in Chicago’s Metropolitan Correctional Center since being arrested in July. He faces separate federal charges in Chicago, New York City and Minneapolis.
